When we share data

We do not sell or rent personal data. We may share only what is reasonably necessary with:

  • LMS, hosting, cloud, video and communication providers that operate the Services on our instructions.
  • Payment gateways, banks and billing providers to process transactions, prevent fraud and handle refunds.
  • Analytics and support providers subject to your choices and appropriate safeguards.
  • Mentors, instructors and authorised team members to deliver teaching, review assignments and support learners.
  • Professional advisers, regulators, courts or authorities where legally required or necessary to protect rights and safety.
  • A successor organisation in a merger, reorganisation or transfer, subject to confidentiality and applicable law.

Processors are expected to use data only for agreed purposes, maintain appropriate security and delete or return data as required by contract and law.

07

International data transfers

Some technology providers may store or process data outside India. Where this occurs, we will use contractual, technical and organisational safeguards required by applicable law and comply with any restriction notified by the Government of India. Contact us if you want information about the safeguards relevant to your data.

08

How long we keep data

We retain personal data only for as long as reasonably necessary for the stated purpose, course/LMS access, security, legal compliance and dispute resolution. Typical criteria include:

  • account and learning records for the access period and a reasonable period afterwards;
  • invoice, payment and tax records for the period required by tax/accounting law;
  • support and contract records while an issue or legal claim may remain open;
  • security and processing logs for applicable statutory periods; and
  • marketing data until you opt out or consent is withdrawn.

We may retain de-identified or aggregated information that no longer identifies you. Deletion requests remain subject to lawful retention requirements.

09

Security

We use reasonable technical and organisational safeguards proportionate to the nature of the data, which may include access controls, encryption in transit, credential protection, backups, monitoring, role-based permissions, vendor controls and incident procedures. No online service can promise absolute security.

You are responsible for keeping your password and one-time codes confidential, using a unique password, signing out of shared devices and promptly telling us about suspicious access. We will provide notices of a personal-data breach where required by applicable law.

10

Your choices and rights

Subject to applicable law, you may request a summary of personal data being processed, information about processing or sharing, correction/completion/updating, erasure, withdrawal of consent, and grievance redressal. You may also nominate another individual to exercise rights in the event of death or incapacity where the law provides.

Email hello@breadthx.com with the subject “Privacy rights request”. Tell us what you seek and the email/mobile linked to your account. We may verify your identity and ask only for information reasonably needed to process the request. We will respond within the period required by applicable law.

Please first use BreadthX’s grievance process. If your grievance remains unresolved, you may have the right to complain to the Data Protection Board of India or another competent authority, once and to the extent the relevant framework applies.
11

Children and learners under 18

The Services are intended for adults. A person under 18 may use a course only through a parent or lawful guardian and where the relevant program expressly permits it. We will seek verifiable parental consent before processing a child’s personal data where required, and will not knowingly undertake tracking/behavioural monitoring of children or targeted advertising directed at children where prohibited.

If you believe a child provided personal data without appropriate permission, contact us so that we can review and take appropriate action.

12

Email, calls, WhatsApp and service messages

We may send essential messages about enrolment, payment, live sessions, security, access or policy changes. With appropriate permission or another lawful basis, we may send educational updates and promotions by email, phone, SMS or messaging services. You can opt out of marketing through the unsubscribe mechanism or by contacting us. Service and transactional messages may continue while you use the Services.

13

Third-party links and platforms

The Services may link to or integrate with the BreadthX LMS, payment pages, video meeting services, social/community platforms, app stores, TradingView or other websites. Those services may independently process data under their own notices. BreadthX is not responsible for an unrelated third party’s privacy practices; review its policy before providing information.

14

Changes to this Policy

We may update this Policy to reflect operational, technological or legal changes. The latest version will be posted here with a revised effective date. If a change materially affects how we use personal data, we will provide additional notice or seek consent where required.
